DMCA Policy for Mushroom Gruyere Pie

Mushroom Gruyere Pie ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Mushroom Gruyere Pie service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA notice and counter-notice.

Filing a DMCA Notice of Infringement

Upon receipt of a valid DMCA Notice, we will take appropriate action, which may include removing or disabling access to the infringing material. We will also notify the user who posted the allegedly infringing material.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may send a written counter-notification ("DMCA Counter-Notification") to our Designated Copyright Agent with the following information:

  • Identification of the material: Identify the specific material that has been removed or to which access has been disabled and the location (URL) where the material appeared before it was removed or disabled.
  • Statement of Good Faith Belief: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact Information of the Counter-Notifying Party: Provide your full legal name, mailing address, telephone number, and email address.
  • Consent to Jurisdiction: Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Mushroom Gruyere Pie may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Signature: Provide a physical or electronic signature.
  • Method of Submission: Please send your complete DMCA Counter-Notification via email to dmca@mushroomgruyerepie.com.

Upon receipt of a valid DMCA Counter-Notification, we will promptly provide the complaining party with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it within 10 business days, unless we first receive notice from the complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material on our Site.
